Privacy Policy

Introduction

HoopDee, Inc (“we”, “our”, “us”) respects your privacy. This policy describes the types of information we may collect from you when you visit our Services at getHoopDee.com (the “Site”) or download our app (the “App”) (collectively as the “Services“) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect on the Site or the App, and in email and other electronic communication between you and the Company.  It does not apply to information collected:

  • Offline or through any other means, including on any other website or app operated by Company or any third party; or 

  • By any third party, including through any application or content (including advertising) that may link to or be accessible from the Services.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, please do not use our Services. By accessing or using our Services, you agree to this privacy policy. This policy may change from time to time. Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates. 

Our Services are not intended for those under 18 years of age.  If you are under 18 and wish to engage with our Services, we require verified parental consent.

Changes to Our Privacy Policy

From time to time we may change our policy to update and accurately reflect our information handling practices or in response to changes in the law.  It is our policy to post any changes we make to our policy on this page with a notice that the privacy policy has been updated on the Services home page. If we make material changes to how we treat our users’ personal information, we will notify you by email to the primary email address specified in your account and/or through a notice on the Services home page. The Effective Date at the top of the page reflects the last revision date of the policy. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Services and this privacy policy to check for any changes.

Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Services, including:

  • Information by which you may be personally identified, such as first and last name, e-mail address, telephone number, user credentials, IP address, or any other identifier (“personal information”);

  • Information that you voluntarily provide as you use or otherwise engage with our Services; and

  • Technical information about your internet connection, the devise or browser you use to access our Services, and other usage details.

We collect this information:

  • Directly from you when you provide it to us.

  • From third parties, for example, our business partners and service providers.

The information we collect on or through our Services may include:

  • Information that you provide by filling in forms on our Services. This includes information provided at the time of registering your account, or when you request information from us about our Services, or when subscribing to our mailing list. 

  • Information that you provide if you report a problem with our Services.

  • Records and copies of your correspondence when you contact us about the Services.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To provide our Services to you.

  • To provide you with information or services that you request from us.

  • To fulfill any other purpose for which you provide your personal information.

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • To notify you about changes to our Services or any products or services we offer or provide through it.

  • To maintain the safety, security, and integrity of the Services, as well as our databases and other technology assets and our business.

  • To notify you about changes to our Services, our Terms of Use, or our privacy policies and to send you security alerts, confirmations, and other administrative messages.

  • To respond to law enforcement requests and as required by applicable laws, rules, court orders, or governmental regulations, as well as to comply with our legal and regulatory obligations and to defend legal claims.

  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets as described in this policy.

  • In any other way we may describe when you provide the information.

  • For any other purpose with your consent.

We may also use your information to contact you about recommendations of goods and services that may be of interest to you. If you do not want us to use your information in this way, please see the “Your Privacy Choices” section below.

Disclosure of Your Information

We may disclose deidentified or aggregated information about our users, and information that does not identify any individual, without restriction. 

We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our users is among the assets transferred.

  • To fulfill the purpose for which you provide it. 

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce or apply our Terms of Use and other agreements, including for billing and collection purposes.

  • To provide information to our representatives and advisors, including our attorneys and accountants, to help us comply with legal, accounting, and security requirements.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Collection and Use of Information from Children 

Our Site is not intended for children. We do not knowingly collect Personal Information from children, and none of the features of our Site is designed to attract children. We have no actual knowledge that we have collected the personal information of any child under the age of 16. In the event that we learn that a person under the age of 16 has provided Personal Information to us, we will delete such Personal Information as soon as possible unless such information is provided with verified parental consent.


We do not sell Personal Information, including those of children under age 13.


Your Privacy Choices

You have choices regarding how we use and disclose the personal information you provide to us. 

  • Promotional Offers from the Company. If you do not wish for us to use your contact information to promote our own products or services, you can opt-out by (1) unsubscribing to promotional emails sent to you through the “Unsubscribe” link in the email; or (2) by sending us an email stating your request to privacy@getHoopDee.com. Please note that we may still use your contact information to provide you with administrative notices or other non-promotion communications related to the Services. 


We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s Services.

Washington residents may have additional rights and choices over their consumer health data.  Please see our Consumer Health Data Privacy Policy for more information.

[Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to us using the information provided in the “Contact Information” section below, indicating that you are requesting to opt-out of the sale of your personal information under Nevada law. However, please know we do not currently sell data triggering that statute’s opt-out requirements.]

Accessing and Correcting Your Information

You can request that we update, correct, or delete any information we possess about you by contacting us using the information in the “Contact Information” section below and informing us of what action you would like to take with respect to your information. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your California Privacy Rights

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us using the information provided in the “Contact Information” section below, indicating that you are submitting a request under the California “Shine the Light” law.

How We Respond To Do-Not-Track Signals 

Our Services does not respond to automated browser signals regarding tracking mechanisms, which may include “Do Not Track” instructions and other global privacy signals. 

Non-U.S. Visitor’s Rights

The owner of the Services is based in the State of Maryland in the United States. We provide this Services for use only by persons located in the United States. Non-U.S. persons visiting from other countries should be aware that, by visiting the Services, you are agreeing to be subject to U.S. privacy laws rather than the laws of your home country. If you access the Services from outside the United States, you do so on your own initiative, consent to the transfer of your personal information to the United States, consent to the use of your personal information as in this privacy policy and are responsible for compliance with local laws.

Non-U.S. persons shall have the same rights as U.S. persons as described in this privacy policy. Exercising those rights is free of charge. Should you have any issues or complaints, we hope you will contact us directly using the information provided in the “Contact Information” section below, although you may have the right to also contact the data protection supervisory authority where you reside if you wish to do so.

Data Security

We have implemented industry recognized, commercially reasonable measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. 

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

Data Retention

We will only keep your information, including any personal information, for as long as necessary to fulfill the purposes for which we collected it, to comply with our legal obligations, or to enforce our legal rights (or as required so others may enforce their legal rights). For example, we will keep your personal information for as long as you maintain your account. 

Generally, the length of time we keep your information will depend on the type of information and the purpose for which we are processing it. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we are processing it and whether we can achieve those purposes through other means, and any applicable legal requirements.

At the end of the appropriate retention period, we will either delete your information from our systems completely or anonymize it so it can be used without identifying you and so we no longer have the ability to re-associate the anonymized information with you in the future, such as by deidentifying or  aggregating the information.

Washington Consumer Health Data Privacy Notice

Effective Date: February 20, 2025

This notice supplements HoopDee Inc’s Privacy Policy and describes how HoopDee, Inc (“we”, “our”, “us”) collects, retains, uses, and discloses any Consumer Health Data (“CHD”) that we may collect. This Notice only applies to Washington residents.

“Consumer Health Data,” as it is defined in the My Health My Data Act of Washington, means personal information that can be linked or reasonably linked to a consumer and that that identifies past, present, or future physical or mental health status.  Consumer Health Data includes information about medical conditions, diagnosis and treatments, as well as non-medical information, such as social or behavioral interventions, biometric or genetic data, information about use of non-prescription health-related products, and non-health information, such as precise location information, that could review access to healthcare, reproductive care, or gender-affirming care.

Please note that this Notice does not apply to how we process protected health information (“PHI”) subject to Health Insurance Portability and Accountability Act (“HIPAA”) and does not apply to how we process health information about our employees.

Categories of CHD Collected

We collect information that you provide to us related to your caring for your newborn.     

Purpose of Collecting CHD

We collect CHD to deliver the services that you request when you engage with our app. 

How CHD is Collected

We collect CHD when you voluntarily provide that information to us when you engage with our app. 

Who We Share CHD With

We share CHD with the following categories of entities:

·   Our service providers;

·   Our affiliates and business partners;

·   Successors or potential successors to all or part of our business in connection with a business transaction, such as a merger, acquisition, joint venture, financing or similar;

·   Third parties in connection with a legal right or obligation, including the establishment, exercise, or defense of legal claims; to comply with laws or to respond to lawful request and legal processes; to protect our rights and property and the rights and property of other, including to enforce our agreements and policies; to detect, suppress, or prevent fraud; to protect the health and safety of us and others; or as required by applicable law; and

·   With others with your consent or at your direction.

Selling or Using CHD for Targeted Advertising

We do not sell your CHD and we do not use your CHD for targeted advertising.

Your Privacy Rights

The My Health My Data Act gives you certain privacy rights with respect to your CHD.  They are:

·   Right to Withdraw Consent – you have the right to withdraw your consent to the processing of your CHD.

·   Right to Access – you have the right to request confirmation of whether we are collecting, sharing, or selling your CHD and to access such data, including a list of all third parties and affiliates with whom we have shared or sold the CHD and contact information such as an email address or other online mechanism for these third parties.

·   Right to Request Deletion – you may have the right to request that we delete your CHD

 

How to Exercise Your Privacy Rights.

To exercise any of your privacy rights described above, please submit a verifiable consumer request to us by either calling us at (410) 929-4742 or sending an email to privacy@getHoopDee.com with the subject line “Washington MHMD Act Privacy Request.”  If you submit your request by email, we may contact you to verify your identity and the validity of your request. 

If we are unable to verify your identity and the validity of your request, we may decline your request.  Alternatively, we may need to contact you to collect any additional information needed to respond to your request. Any additional information collected in connection with your rights request will only be used for the purpose of responding to your request.  If we decline your request, we will let you know within 45 days of receiving your request and provide you with a method of appealing our decision.

 

Updates to this Privacy Notice

We reserve the right to amend this Privacy Notice at our discretion and at any time. If we change the way we collect, use, or disclosure your Consumer Health Data that require us to make changes to this Privacy Notice, we will post a notice on this page and update the Notice’s effective date. Your continued use of our Sites or our services following any posted updates to the Notice constitutes your acceptance of such changes. If you object to any of the changes to our Notice, you must stop using the app or our services.
